MOBILE HOME HOLIDAYS WEBSITE TERMS OF USE
Please note: Do not book any flights, ferries or make any other travel arrangements until you have received full verbal confirmation of your booking from one of our reservation team via telephone.
YOUR HOLIDAY CONTRACT
We act as agents for Lifestyle Holidays Ltd, TTA member and as such the contract is between Lifestyle Holidays Limited a member of the TTA and the client being any person traveling or intending to travel on a tour operated by the company. The contract, including all matters arising from it, is subject to English law and the exclusive jurisdiction of the English courts. You may however choose the law and jurisdiction of Scotland and Northern Ireland if you wish to do so. No variation of these terms will be valid unless confirmed in writing by us. A contract will exist as soon as we issue our confirmation invoice. By making a booking, the lead passenger confirms that all people's names in the booking (and their personal representatives) have agreed to be bound by these conditions and the terms of its suppliers.
YOUR FINANCIAL PROTECTION
The Package Travel, Package Holiday and Package Tours Regulations 1992 require us to provide security for the monies that you pay for the package holidays booked through our company and your repatriation in the event of our insolvency.
THIS AGREEMENT is between you, the user of this Site, and MobileHomeHolidays.com.
Your use of this website is subject to your irrevocable acceptance without modification of these terms of use (the "Terms") and you agree to use this website in accordance with and subject to these Terms. The Terms as set out hereunder constitute the entire agreement between you and MobileHomeHolidays.com ("MMH", "we" or "us"). If you do not read or accept these Terms, do not use this website. By accessing any part of the MMH website, you consent to be bound by these Terms.
NO LIABILITY
MMH uses reasonable endeavours to check the accuracy of information published on this website. You should note however that MMH does not warrant that such information will be error free and in using this website you acknowledge that the information published on this website may include inaccuracies or typographical errors.

MMH is not in any way liable in respect of any damage or loss of whatsoever nature suffered by you arising from or in any way connected with the use of this website.

As a condition of your use of this website, you undertake to MMH that you will not use this website for any purpose that is unlawful or prohibited by these Terms.

You agree to indemnify and hold MMH its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the website.

MMH reserves the right to change these Terms as well as the contents of this website for any reason and without notice, and without liability to you, any other user or any third party. You should check these Terms for any changes each time you access the website.
GENERAL TERMS AND CONDITIONS
These Terms and your use of this website are governed by the laws of the Italy . You hereby consent to the exclusive jurisdiction of the Italy courts in all disputes arising out of or relating to the use of this website each time you access the site. Use of this website is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions including without limitation this paragraph.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and MMH as a result of these Terms or your use of this website. MMH's performance of these Terms is subject to existing laws and legal process and nothing contained in this agreement is in derogation of MMH's right to comply with law enforcement requests or requirements relating to your use of this website or information provided to or gathered by MMH with respect to such use.
If any part of these Terms is determined to be invalid or unenforceable, including but not limited to the disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall continue in effect.
MMH's failure to enforce at any time or for any period any one or more of the Terms shall not be a waiver of them or the rights attaching to any of them.
The headings used in these Terms are for convenience only and shall not affect the meaning or scope of these Terms or otherwise be given other legal effect.
These Terms constitute the entire agreement between you and MMH with respect to this website and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and MMH with respect to this website. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Although MMH cannot monitor the conduct of its users offsite, it is a violation of these Terms to use any information obtained from this website in order to harass, abuse or harm other persons, or in order to contact, advertise to, solicit or sell to any user or person without their prior express consent.
IF YOU HAVE A PROBLEM
In the unlikely event of they're being something not to your liking whilst you are on holiday that is in our direct control you must report it immediately. This will give our representative an opportunity to correct the matter so that it does not spoil your holiday. Unless there is a valid reason why you fail to report your complaint to our Go4Spain representative then we will not consider ourselves to be liable in respect of complaints, which were not registered in resort. Your holiday enjoyment is our prime consideration. If the matter cannot be put right on the spot, detail of your complaint should be recorded on a Comment form available on request in resort. This should be handed to our representative; they will then give you a copy of the form, which together with an accompanying letter must be forwarded to our UK office address within 28 days of the completion of the holiday. We will not accept liability in respect of claims outside this period. Please note that in any event any compensation payable for claims against MMH other than compensation for personal injuries will not exceed two times the cost of the holiday. If your holiday is arranged through an agent and not directly with us then all monies paid to the agent in anticipation of a contract with MMH are held by him as your agent until the booking is accepted and there after as our agent. Under no circumstances will any agent of ours have authority to expressly or implied alter the terms of the contract unless that agent has written authority to do so.
IF YOU CHANGE YOUR BOOKING
If after your booking has been accepted you wish to transfer to a different holiday , change departure, or alter any detail of the booking we shall do our utmost to satisfy your requirements. If the change is 56 days or more before departure there will be an amendment fee of £25. Any change to details on the booking within 6 weeks of departure will incur a cancellation charge as set out in the paragraph ‘If You Cancel Your Holiday' below unless the new holiday departs on or before the original departure date in which case the normal amendment fee of £25 will be charged. If you have authorised the automatic debiting of your credit/debit card, the appropriate amount (which we will have previously confirmed to you) will be debited accordingly.
IF YOU CANCEL YOUR HOLIDAY
Should you or any member of you party be forced to cancel your booking once it has been accepted a valid cancellation can only be made if you give written instruction to us sent by recorded delivery. The person who signed the booking form must sign the instructions. The effective date for the cancellation will be the date we receive your written instructions in our office. For this reason telephone, fax or email cancellations cannot be accepted. If you cancel, a cancellation charge (being agreed damages to cover your estimated loss) calculated on the scale set out below becomes payable by you as signatory of the booking form. If you have authorised the automatic debiting of your credit /debit card, the appropriate amount (which we will have previously confirmed to you) will be debited accordingly. Please note you may be able to make a claim under your holiday insurance.

IF WE CHANGE YOUR BOOKING
As you will appreciate holiday arrangements are planned many months in advance and on rare occasions it may be necessary to make a modification to them and we reserve the right to make such changes at any time. In the majority of cases such changes will be minor but if they are of a more substantial nature we will do our best to advise you prior to your departure. If we are forced to make major changes notified before departure to your holiday we will pay you compensation in accordance with the table below. Such major changes being: Change of scheduled ferry route Change of Accommodation
If you choose to accept the changed arrangement or purchase another holiday from us we will pay you compensation on the scales shown below. If you choose not to accept the change to arrangements we will refund you all the monies paid to us.

PAYMENT OF THE HOLIDAY
We will send out a final invoice on payment of your final balance. This should be no later than 90 days before your departure. If you do not you could be liable for cancellation charges of up to 100% of the final invoice because we reserve the right to treat the booking as cancelled by you at anytime up to the date of departure. Therefore it is very important for you to pay the balance 90 days before departure or write cancelling your holiday. A 3% charge will be levied on the final balance of all bookings when a credit card is used to pay any element of the holiday package. No charge for debit cards.
SPECIAL REQUESTS
Whilst we make every effort to adhere to any special requests no guarantee can be given. We may not be able to notify you before departure if we are unable to meet any special requests. Location on the campsite and group/family bookings are regarded as special requests.
PRIVACY POLICY
Full details of MMH's privacy policy can be found below and is hereby incorporated into and forms part of these Terms.
If at any time you believe that MMH has not adhered to these principles, please notify us via the contact form and we will use all commercially reasonable efforts to determine and correct the problem promptly.

PRIVACY AND SECURITY STATEMENT
MobileHomeHolidays.com realises some people are unsure about entering their personal details into websites over the Internet. Below, we explain how we use your information and how we protect your privacy. MMH and its associated companies respect and protect your right to privacy in relation to your interactions with this website. Any information which is provided by you to MMH via this website or otherwise will be treated in accordance with the terms of the Data Protection Acts, 1988 and 2003 and/or such amending or replacement legislation as may be adopted in Ireland from time to time.
INFORMATION REQUIRED TO PROCESS YOUR BOOKING
For us to process a booking for you, we require some information from you. This includes your name, nationality, your gender (or the gender of the group you are in), your phone number and email address. Also, since we confirm your booking while you are on the site, we require your credit or debit card details so we can confirm your booking when you pay your deposit.
WHO SEES YOUR INFORMATION
We are required to send your information to the travel services provider with which you booked travel services so that the travel service provider knows who you are and when you will use its travel services. We give your name, your nationality, your gender (or the gender of the group you are in), your phone number, your email address, your credit card details and of course, the details of your booking. The travel service provider requires this information to accept a confirmed booking from you. All travel service providers on whose behalf we facilitate bookings have agreed to the Mobilehomeholidays.com terms and conditions and accept this privacy policy.
SECURITY
All sensitive information exchanged between your computer and our Web Reservations International Ltd Booking engine is encrypted using a SSL. This ensures that your information is transmitted securely and is safe from third parties. You should be aware that where you link to another web site from this web site, that MMH has no control over that other web site. Accordingly, MMH cannot guarantee that the controller of that web site will respect your privacy in the same manner as MMH.
HOW WE USE YOUR INFORMATION
We only use your email address for sending you a confirmation of your bookings or to contact you for any reason directly linked to your booking, or occasionally to inform you of new features on Mobilehomeholidays.com. We only use your phone number to contact you urgently if there is a problem with your booking. You have the right to request a copy of the information which we hold about you (for which we may charge you a small fee) and to have inaccuracies in the information corrected. On occasions, we may supply statistics about our customers to third-parties such as hostels or other agents. These statistics never contain personally identifying information.
